Federal Judge Dismisses Defamation Lawsuit by Former Trump Supporter Against Fox News

A federal judge has once again dismissed a defamation lawsuit brought by Raymond Epps, a former Oath Keeper and Trump supporter, against Fox News. Epps claimed the network’s repeated airing of conspiracy theories portraying him as a government operative who incited violence during the January 6 2021 Capitol attack led to death threats forcing him and his wife to sell their Arizona ranch and live in a recreational vehicle.

US District Judge Jennifer L Hall ruled that Epps failed to provide sufficient evidence of actual malice the legal threshold required in such cases against media organisations. She determined that neither former host Tucker Carlson nor others at the network could be shown to have knowingly broadcast false information or acted with reckless disregard for the truth.

Epps who had been an avid viewer of Fox and Carlson’s program had pleaded guilty to a misdemeanor charge related to the Capitol events and later received a pardon from Donald Trump along with roughly 1 500 others. Federal prosecutors have supported his denial of any connection to the FBI or government beyond his earlier service in the US Marines.

Fox News welcomed the decision describing it as an important affirmation of press freedoms under the First Amendment. The ruling marks the second time the court has rejected Epps’ claims though he had been given an opportunity to amend his complaint.

The case highlights ongoing legal battles stemming from media coverage of the Capitol attack and the high bar plaintiffs face when suing news outlets over allegations of defamation.
