A California jury threw out the entire case unanimously after just two hours of deliberation.
The case was thrown out because Musk filed it too late. The legal deadline to bring the lawsuit had already passed.
Musk had given $38 million to OpenAI when it was a nonprofit. His argument was straightforward.
He donated money to build AI for the benefit of humanity, not to create a for profit company that is now valued at over $852 billion. On the stand he said "it's not okay to steal a charity."
Altman told the jury a different version. He said Musk was aware of and supported the transition to a for profit structure, and that Musk himself wanted personal control of the company for the long term.
But the case never actually got decided on its merits. It was thrown out purely on procedural grounds because Musk missed the legal filing deadline. The underlying question of whether OpenAI's conversion from nonprofit to for profit was legitimate was never answered.
Musk left OpenAI in 2018 after the other founders refused to give him control. He then started xAI to compete directly with OpenAI.
Critics say the lawsuit was an attempt to slow down a competitor. Musk says he was trying to hold OpenAI accountable to its original mission.
