Recently, an open-source project named 'Zhang Xuefeng.skill' has attracted widespread attention on GitHub. This project extracts the unique consulting style, decision-making logic, and expression methods of the late well-known educational consultant Zhang Xuefeng by collecting his five published works, over ten in-depth interviews, more than thirty quotes, and several key decision records, packaging it into an AI agent skill file. Users can obtain highly mimicked consulting advice that reflects Zhang Xuefeng's thinking and tone through an AI tool in a conversational format. This technical attempt has been referred to as 'cyber resurrection' by some netizens.
In response, lawyers believe that the personality and economic interests carried by the deceased's name are protected by law, and the generated economic benefits can be inherited and enjoyed by close relatives. Using the deceased's name for AI agent product naming and commercial promotion without the consent of close relatives may lead to public misunderstanding that the product has a specific connection with Zhang Xuefeng or his family, and directly infringes on the personality and economic interests carried by the deceased's name. Therefore, Zhang Xuefeng's close relatives have the full right to request the infringer to cease infringement, apologize, and compensate for damages according to Article 994 of the Civil Code.
