The court concluded that the head of state did not have the right to impose large-scale tariffs, citing the International Emergency Economic Powers Act. The ruling notes that this law does not grant the president the authority to unilaterally set import duties.
The judges who voted for the repeal of the tariffs were Ketanji Brown Jackson, Elena Kagan, and Sonia Sotomayor, as well as conservatives Amy Coney Barrett, Neil Gorsuch, and Chief Justice John Roberts. Opposing them were Brett Kavanaugh, Samuel Alito, and Clarence Thomas.
The decision provoked a sharp reaction from the president. A few hours after its announcement, Trump held an unscheduled press conference, during which he stated that he was deeply disappointed with the court's position. He criticized the conservative judges who supported the repeal of tariffs, calling them "bad Republicans."
In addition, Trump announced his intention to impose a new global tariff of 10% on goods from all countries and signed the corresponding decree. According to him, the court's decision did not weaken, but rather clarified and strengthened presidential powers in the area of trade regulation.
The president also emphasized that he intends to use other legal mechanisms to impose higher tariffs in the future.
