SEC and CFTC Officially Recognize 16 Tokens as Commodities Accounting for 80% of Global Crypto Capitalization
🔸 On March 11, 2026, the SEC and CFTC officially signed a historic Memorandum of Understanding, followed by a joint explanation on March 17, bringing legal clarity to digital assets after 8 years of waiting. Accordingly, ETH along with 15 other tokens are officially classified as commodities, ending a dispute that has lasted since 2018 when former SEC director William Hinman first suggested that ETH is not a security.
🔸 16 tokens are recognized including: BTC, ETH, SOL, XRP, ADA, LINK, AVAX, $DOT , HBAR, LTC, $DOGE , $SHIB , XTZ, BCH, APT, XLM. They account for about 78-80% of the total market capitalization of crypto. The MOU also clearly defines activities such as PoW mining, PoS staking, wrapping, and airdrop as not being securities transactions as long as there is no expectation of profit from the efforts of a third party.
