4 KETENTUAN UTAMA BILL INI

1️⃣ Wash Sale Rule — Loophole Ditutup
Saat ini, crypto diperlakukan sebagai properti, sehingga trader bisa jual aset yang merugi untuk klaim tax deduction, lalu langsung beli balik aset yang sama — sesuatu yang TIDAK bisa dilakukan investor saham. (BitcoinEthereumNews.com)
Jika wash sale provision lolos, menjual Bitcoin di harga rugi dan membeli kembali dalam 30 hari akan mendiskualifikasi klaim loss — aturan yang sama yang selama ini berlaku untuk investor saham selama beberapa dekade. Strategi rebalancing portofolio akhir tahun harus disesuaikan dengan periode tunggu ini.

2️⃣ Stablecoin Tax Exemption — De Minimis $200
Bill ini mengeliminasi capital gains tax untuk transaksi di bawah $200 ketika pengguna membayar dengan stablecoin yang diterbitkan oleh perusahaan yang patuh dengan GENIUS Act. (Bitcoin News)
Versi final Mei 2026 juga memperluas ini — payment stablecoin akan dibebaskan dari kewajiban pelaporan pajak dalam kasus penukaran, mirip dengan perlakuan uang kas, kecuali gain/loss melebihi 1% dari nilai aset digital.

3️⃣ Staking & Mining — Phantom Income Selesai
Di bawah interpretasi IRS saat ini, staking rewards sering dikenai pajak begitu dikreditkan ke wallet, tanpa peduli apakah token tersebut terkunci di protokol atau cukup likuid untuk membayar tagihan pajaknya. (Crypto Times)
PARITY Act menyelesaikan ini dengan membiarkan stakers memilih untuk menunda pajak aset hingga lima tahun. "Phantom income" hanya akan diakui sebagai ordinary income berdasarkan fair market value saat rewards dicairkan atau ditransfer.

4️⃣ Mark-to-Market & Crypto Lending
Trader dan dealer yang memenuhi syarat bisa menggunakan mark-to-market accounting, menempatkan crypto trading dalam kondisi yang setara dengan pasar sekuritas tradisional. Bill ini juga menawarkan perlakuan non-kena pajak untuk pengaturan crypto lending yang berfungsi sebagai pinjaman nyata, bukan penjualan aset.
