🇧🇷 MP 1.303 fell. And now, what changes for the crypto market in Brazil?
The Provisional Measure 1.303/2025, which proposed the taxation of virtual assets, was archived by Congress after strong political rejection. The result? The crypto sector continues without clear regulation, but also without immediate taxation. 🧵
📌 What does this mean in practice:
✅ Virtual assets remain non-taxable in Brazil
✅ Exemption of R$ 35,000.00 per month remains in effect
🛑 Self-custody and users continue without defined legal security
🏛️ VASPs (brokerages, exchanges, custodians) still without clear regulatory obligations
❗ No fiscal regularization regime (RERAV) will be applied for now
💬 The message is clear: the government tried to "tax before regulating" — and Congress said no.
The scenario remains the same:
Legislation (Law 14.478/2022) approved
But the Central Bank and the CVM have not yet published specific rules
In other words, the crypto sector continues in a regulatory gray area

➡️ The government is studying new decrees and ordinances to maintain part of the expected revenue
➡️ Congress may issue a legislative decree within 60 days to validate acts of the MP
➡️ But, without a clear legal basis, the risk of legal insecurity increases
