Hello 500 kind brothers on Binance Square,
Today I come up not to "share the deal" or analyze the chart, but to discuss the "bread and butter" and... the "legal aspects" of our own brothers. The thing is the "gray area" that our crew has been struggling in (KOL, doing referrals, affiliate...) seems about to get the "green light"... or "red light" depending on the way of playing!
The hot news is that Resolution No. 05/2025/NQ-CP has just been issued, and it feels like a "martial law" for the crypto market in Vietnam.
How did we "chill" back then?
Remember the time when we just needed to throw a referral link on "Facebook", "TikTok", and make a few "call trades" videos and the commissions would roll in? Every international platform participated, every referral was accepted. To be blunt, it was a "gray area", but it was... fun.

And this is "The New Game":
Resolution 05 states clearly:
Want to promote? Must have a license!: Only organizations/individuals approved by the Ministry of Finance can promote or market crypto. The era of "spontaneity" is over.
The "Critical Link": The referral link for the platform (not yet approved) that we often share could now be flagged as "illegal promotion". Sounds serious!
The Final Blow (Heaviest): 6 months after the first platform is officially licensed, if we are still trading "underground" outside this system... we could be "questioned" (from administrative fines to worse).
So what will happen to our "Rice Bowl" (KOL/IB/Referral)?
To put it plainly, the time of "posting a link and earning referrals for life" is coming to an end.
If you still "call trades" like "This trade x100, go for it!", "Sign up for this link right away..." without a license, it's not just a matter of "losing credibility" when the trade collapses, but you could also be "taken away" for illegal advertising.
But... Is it really over? Or is this the time to "level up"?
Actually, I see this as a time for "cleansing" the market. Those who create "junk" content will be automatically eliminated. Those who are "smart" and dedicated will survive.
The legal path is still open, but it's "harder":
Content System Transition: Instead of "calling trades", we will shift to analysis, knowledge sharing, and risk warnings. Most importantly: Every post must include a prominent Disclaimer. More professional, and protect ourselves.
Make "Real Goods": When there is a licensed platform, we can become "authorized agents". Clear contracts, transparent commissions.
Pay Taxes!: This is the most confusing part for us. How will our affiliate income be taxed?
Type 1: Flat tax of 7% (5% VAT + 2% Personal Income Tax) like service business households?
Type 2: Progressive tax of 35% (Personal Income Tax) like salaried employees?
If this isn't clear, the IB (Introducing Broker) will also "scream", as it directly affects their "rice bowl".
Conclusion:
"The rules" have been set, we can't "bend" them forever.
Times are changing, we also have to "transform". This is a golden opportunity to "reposition" ourselves. From being a "KOL calling trades", we can become "Analysts/Educators" in the digital financial market.
Listening is "cooler", isn't it?
