Cryptocurrency has long ceased to be a toy for techies — it has become part of the financial life of hundreds of thousands of Ukrainians. But there is one topic that everyone is silent about, even though it concerns every crypto owner: what will happen to your coins after death?

And this is where the most interesting part begins.

🔐 1. The private key is the ownership right.

Ordinary inheritance (apartment, car, bank account) exists physically. Even if the documents are lost, the notary can restore ownership rights.

❗ With crypto — everything is the opposite.

  • No key or seed phrase?

  • No technical access to the wallet?

💥 Everything. Period. The notary is powerless. The court is powerless. The state is powerless.

  • access mechanism (box, safe, two-factor system).

That is, you are transferring not the asset itself, but the key to the asset.
This is critical.

The Ukrainian notariat is encountering a situation for the first time where:

  • the notary must confirm the testator's will;

  • but has no right to store private keys;

  • and must guarantee complete confidentiality.

In the USA, Canada, the Netherlands, Japan, there are:

  • digital wills;

  • access protocols for wallets;

  • legal tools for key transfer;

  • inheritance smart contracts.

And yes, there have already been precedents in the world where heirs received the right to crypto in court — but…
without a seed phrase, this right is worthless.

E-notary, digital registers, automation — this opens the way to creating a mechanism for inheriting crypto assets.

But until this mechanism exists, the responsibility lies with the owner.

Your bitcoins will not be inherited by anyone if you haven't left an access instruction.
No one. Even if the heir has a will, a certificate, and 10 court decisions.

✔️ 1. Create a will mentioning digital assets.

At least at the level of 'I have cryptocurrency assets, I transfer them...'.

✔️ 2. Anticipate the method of transferring private keys.

Without disclosing the content to the notary.

✔️ 3. Use one of the secure options:

  • cold wallet in a bank safe;

  • encrypted file with instructions;

  • multi-sig with a third party;

  • seed phrase in a physical safe.

✔️ 4. Prepare the heirs.

Most families do not even know that someone has crypto.
This is a mistake.

✔️ 5. Do not procrastinate.

No one among crypto holders plans to lose access.
But there is one rule:
if the key is lost — the bitcoin is also lost.
