A coalition of 20 US states, led by California, has filed a lawsuit against the Trump administration over the newly imposed $100,000 H-1B visa fee, calling it unconstitutional and unlawful.
California Attorney General Rob Bonta said the fee amounts to an illegal attempt to dismantle the H-1B programme, which Congress—not the President—has the authority to regulate. The fee was introduced by the Department of Homeland Security on September 19, 2025 through a presidential proclamation.
“This is a six-figure surcharge designed to destroy the programme,” Bonta said, adding that no president can rewrite immigration law or bypass Congress.
The states argue that the move violates the Administrative Procedure Act and the US Constitution, as it bypasses required rule-making procedures. They also warn the fee will worsen labour shortages in critical sectors like education and healthcare, which heavily depend on skilled foreign professionals.
Currently, H-1B application fees range between $960 and $7,595. The lawsuit notes that nearly 30,000 educators and 17,000 healthcare professionals on H-1B visas work across the US. With the country already facing a projected shortage of 86,000 doctors by 2036, the states say the policy threatens essential public services.
Bonta revealed this is the 49th lawsuit California has filed against the Trump administration since January, stressing that immigration laws cannot be changed “on a whim.”
The lawsuit seeks to block the fee and reaffirm Congress’s authority over immigration policy.
