Spain Pushes Ahead on Crypto Regulation While the US Falls Behind Spain is moving fast to become one of Europe’s most crypto-regulated markets, as it prepares to fully implement Markets in Crypto-Assets Regulation (MiCA) and Directive on Administrative Cooperation (DAC8) by 2026. While Europe tightens its framework, the United States is still stuck in legislative limbo. From January 1, 2026, Spain will enforce DAC8, a major tax transparency law that requires crypto exchanges and service providers to automatically share user transaction data, balances, and movements with EU tax authorities. This marks a clear shift toward full transparency, effectively ending anonymity in crypto transactions within Spain. Meanwhile, MiCA will become fully effective in Spain by mid-2026. Although MiCA has already applied across the European Union since December 30, 2024, Spain used a transitional window allowing existing crypto firms to operate under old rules until July 1, 2026. This approach gives businesses time to adapt while still offering investors long-term regulatory clarity. Across the Atlantic, the contrast is stark. The US crypto market structure bill, often referred to as the Clarity Act, remains stalled in Congress. While the House has already passed the bill, the Senate has delayed final action, leaving regulatory uncertainty hanging over the industry. That said, movement may finally be coming. According to White House AI and crypto czar David Sacks, the Senate is expected to take up the bill during a January committee markup in 2026. Market experts believe clearer rules in major economies could unlock broader institutional participation next year.
