The Supreme Court and the Supreme Procuratorate issue legal interpretations on criminal cases of money laundering, effective from August 20, 2024.
According to Foresight News, the Supreme People's Court and the Supreme People's Procuratorate jointly issued (Interpretation on Several Issues Concerning the Application of Law in Handling Criminal Cases of Money Laundering) (Interpretation), which will take effect from August 20, 2024.
(Explanation) A total of 13 provisions clearly define the criteria for recognizing 'self-money laundering' and 'third-party money laundering' crimes, as well as the criteria for reviewing the subjective awareness of 'third-party money laundering' crimes and the criteria for recognizing the severity of money laundering crimes.
(Explanation) It also clarifies seven specific circumstances of 'concealing or disguising the source and nature of criminal proceeds and their benefits by other means', the principle of concurrent punishment for money laundering crimes and crimes of concealing or disguising criminal proceeds and benefits, the standards for the amount of fines, and the criteria for leniency in punishment.
