Court Schedule

The sentence is set for December 11, 2025.

The hearing will take place at the United States District Court for the Southern District of New York, in room 1305 (Courtroom 1305), at 40 Foley Square, New York, NY 10007.

The prosecution (U.S. Attorney's Office) is requesting the maximum possible sentence of 12 years in prison.

The defense is asking for a maximum of 5 years, citing already served time in detention in Montenegro, as well as anticipated legal proceedings in other countries.

Judge Paul Engelmayer recently requested clarifications from the parties regarding issues related to —

the possible consideration of time spent by Do Kwon in custody in Montenegro when rendering the U.S. sentence;

whether there will be a stay/termination of the U.S. sentence if Do Kwon is extradited to South Korea, where he may face separate charges.
