Automatic renewal of CNH for drivers without infractions

Drivers who have not received traffic fines in the last 12 months may have their National Driver's License (CNH) renewed automatically. This possibility was established by Provisional Measure (MP) No. 1,327/2025, signed by President Luiz Inácio Lula da Silva and published in the Official Gazette of the Union on Wednesday (10). The regulation is already in effect but needs to be approved by the National Congress within 120 days to become permanent.

The MP amends the Brazilian Traffic Code (Law No. 9,503/1997), which already provided for the Positive National Driver Registration (RNPC) — a database that gathers the names of drivers who have not committed infractions with points within a year.

The main novelty is that drivers registered in the RNPC are exempt from taking Detran exams when the validity of their CNH or Authorization to Drive Moped expires.

Exceptions provided

- The benefit does not apply to drivers aged 70 or older.

- Drivers between 50 and 70 years old can only benefit from automatic renewal once.

- Drivers suspected of physical or mental disabilities, or with illnesses that may compromise their ability to drive, are still required to undergo Detran exams.

Physical or digital CNH

The MP also guarantees the driver the choice between receiving the CNH in physical or digital format. The document, as currently occurs, must contain a photo, name, and CPF and is valid as identification throughout the national territory.

Validity period of the CNH

- 10 years for drivers under 50 years old;

- 5 years for drivers between 50 and 70 years old;

- 3 years for drivers over 70 years old.

Mandatory exams

The measure maintains the requirement for psychological evaluation for those requesting their first driver's license and for drivers wishing to engage in paid activities with a vehicle, such as taxi drivers, app drivers, truck drivers, delivery drivers, and motorcycle taxi drivers.

The physical, mental, and psychological fitness exams must be conducted by professionals accredited by the National Traffic Secretariat (Senatran), which also defines the amounts to be charged.
